kwAI, Inc. Fair Use Policy

This Fair Use Policy applies to subscription plans advertised as "Unlimited" within https://ikwai.ai and https://app.ikwai.ai (the "Service") and forms part of the kwAI Terms of Service.
I. PURPOSE
Unlimited access is designed to support legitimate business prospecting activity conducted by individual users and teams in the normal course of business.
"Unlimited qualified prospects" means there is no fixed numeric cap on prospect visibility or qualification volume. However, usage remains subject to this Fair Use Policy to ensure platform integrity, system stability, and equitable access for all customers.
II. FAIR USE STANDARD
kwAI may apply safeguards where usage patterns:
• Are inconsistent with typical human prospecting behavior
• Indicate automated mass extraction or scraping attempts
• Cause material performance degradation to the platform
• Attempt to bypass, manipulate, or circumvent plan boundaries or system controls
Fair use determinations are made at kwAI’s reasonable discretion based on behavioral, technical, and operational signals.
III. SAFEGUARDS
If usage exceeds reasonable fair use standards, kwAI may implement protective measures, including but not limited to:
• Rate limiting
• Throughput caps
• Export throttling
• Additional verification requirements
• Temporary usage review
• Required upgrade to the Herd Hub plan or appropriate enterprise tier
Safeguards are designed to preserve system performance and ensure responsible usage across the platform.
IV. ADMIN NOTIFICATION
When practical, account administrators will be notified if fair use safeguards are triggered. Notifications may include contextual information and recommended next steps to restore standard usage levels.
V. NO GUARANTEE OF UNRESTRICTED SYSTEM ACCESS
Unlimited plans do not guarantee unrestricted system resources, infrastructure priority, or bulk data extraction rights. All access remains subject to technical limitations, system health protections, and compliance with the Terms of Service.
VI. POLICY MODIFICATIONS
kwAI reserves the right to update or modify this Fair Use Policy at any time. Continued use of the Service following such updates constitutes acceptance of the revised policy.
