kwAI, Inc. Refund Policy

This Refund Policy applies to subscriptions purchased through https://app.ikwai.ai (the “Service”) and forms part of, and is incorporated into, the kwAI Terms of Service. In the event of a conflict between this Refund Policy and the Terms of Service, the Terms of Service shall control except with respect to refund-specific provisions expressly stated herein.

I. FREE TRIAL

kwAI offers a fourteen (14) day free trial. No payment method is required to access the trial.

During the trial period, users receive full platform access for fourteen (14) days. Prospect generation during the trial is limited to a maximum of fifty (50) prospects within the trial period.

At the end of the trial, users may choose to subscribe to a paid plan. No charges are made unless the user actively selects a paid subscription.

Each user or organization is eligible for one (1) free trial unless otherwise approved by kwAI in writing. Creating multiple accounts to extend, bypass, or manipulate trial limitations constitutes abuse of the platform and may result in suspension, termination, or denial of future access.

II. STANDARD REFUND WINDOW

Paid subscriptions (monthly or annual) are eligible for a refund request within fourteen (14) days after the trial period ends and the first successful billing charge occurs.

Refund eligibility applies only to the first billing period following the trial and does not apply to renewals or subsequent billing cycles.

Refunds are granted at the discretion of kwAI, Inc. However, kwAI may transition to an automatic refund structure in the future.

Refund requests submitted after the fourteen (14) day window are not eligible for refund.

III. RESULTS-BASED CONCERNS

kwAI does not guarantee sales outcomes, revenue generation, response rates, or business performance improvements.

If a subscriber believes they are not achieving expected results, kwAI will first provide consultation support to review targeting inputs, ideal customer profile configuration, persona alignment, and offer positioning.

If, after consultation and reasonable adjustment efforts, the subscriber continues to experience unsatisfactory results:

  • If the subscriber wishes to continue using the Service, kwAI may issue an account credit for the affected billing period.

  • Or, If the subscriber does not wish to continue, kwAI may issue a refund for that billing period, subject to the fourteen (14) day refund window.

IV. NON-REFUNDABLE FEES

The following fees are non-refundable:

  • Enterprise onboarding fee

  • Custom onboarding fees

  • Any custom implementation or configuration services

These fees cover time, resources, and services rendered and are not eligible for refund once work has commenced.

V. EARLY CANCELLATION

If you cancel your subscription before the end of a billing cycle, your access to the Service will continue through the remainder of the paid billing period in accordance with the Terms of Service. No prorated refunds are provided for partial billing periods.

VI. ABUSE AND TERMS VIOLATIONS

Refunds will not be issued in cases involving:

  • Violation of the Terms of Service

  • Abuse of the platform

  • Fraudulent activity

  • Misuse of prospect data

  • Creation of repeated trial accounts or manipulation of billing systems

kwAI reserves the right to deny refund requests in such cases.

VII. CHARGEBACKS

If a chargeback is initiated without first contacting kwAI support to resolve the issue, kwAI reserves the right to immediately suspend or terminate the associated account.

Chargebacks may result in permanent loss of access to the Service and may disqualify the account holder from future use of kwAI services.

VIII. HOW TO REQUEST A REFUND

To request a refund, users must contact support at hey@i-kwai.com within the applicable refund window. Refund requests must include the account email and reason for the request.

kwAI will acknowledge receipt of refund requests within five (5) business days.

If approved, refunds will be processed within ten (10) business days. The time required for funds to appear in your account may vary depending on your payment provider or financial institution.

IX. DISPUTES AND JURISDICTION

Any disputes arising out of or relating to this Refund Policy shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

The parties agree to first attempt to resolve any dispute informally by contacting the other party and engaging in good faith discussions.

If the dispute is not resolved informally, it shall be submitted to confidential mediation administered by JAMS in accordance with its applicable mediation rules.

If the dispute is not resolved through mediation, it shall be finally resolved by binding arbitration administered by JAMS in accordance with its applicable arbitration rules and procedures.

The arbitration shall take place in Delaware, unless otherwise agreed in writing by the parties. The arbitration shall be conducted on an individual basis only, and not as a class action, consolidated action, collective action, or representative proceeding to the fullest extent permitted by law.

By agreeing to arbitration, the parties waive the right to a trial by jury and waive the right to participate in any class or representative action.

Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Each party shall bear its own attorneys’ fees and costs unless otherwise required by applicable law or determined by the arbitrator.

This section supplements and is subject to the arbitration and dispute resolution provisions contained in the Terms of Service. In the event of any inconsistency, the Terms of Service shall control.

X. POLICY MODIFICATIONS

kwAI reserves the right to modify this Refund Policy at any time. Changes will be posted within the App or on the Site. Continued use of the Service after changes take effect constitutes acceptance of the updated policy.
