kwAI, Inc. Refund Policy

This Refund Policy applies to subscriptions purchased through https://app.ikwai.ai (the “Service”) and forms part of, and is incorporated into, the kwAI Terms of Service. In the event of a conflict between this Refund Policy and the Terms of Service, the Terms of Service will control, except for refund-specific provisions expressly stated in this Refund Policy.

I. Free Trial

kwAI offers a fourteen (14) day free trial for the Grazing plan. A valid payment method is required to access the free trial.

During the trial period, users receive access to the Service under the Grazing plan for fourteen (14) days.

No charges are made during the trial period. At the end of the trial, users will be charged using the payment method on file unless they cancel before the trial period ends.

Each organization is eligible for one (1) free trial unless otherwise approved by kwAI in writing. Creating multiple accounts to extend, bypass, or manipulate trial limitations constitutes abuse of the platform and may result in suspension, termination, denial of future access, or denial of refund eligibility.

II. Refund Window

First-time paid subscriptions, whether monthly or annual, may request a refund within fourteen (14) days after the free trial ends and the first successful billing charge occurs.

Refund eligibility applies only to the first billing period following the free trial. It does not apply to renewals, subsequent billing cycles, plan upgrades, add-ons, or additional purchases unless otherwise required by applicable law.

For annual subscriptions, this refund window applies only to the first annual charge following the free trial.

Refund approval is subject to this Refund Policy, the Terms of Service, and review by kwAI.

Refund requests submitted after the fourteen (14) day refund window are not eligible, except where required by applicable law or where kwAI determines that a refund or credit is appropriate due to a platform outage, billing error, technical issue, or service failure caused by kwAI.

III. Results

kwAI does not guarantee specific sales outcomes, booked meetings, revenue generation, response rates, lead volume, contact accuracy, or business performance improvements.

Refunds are not granted solely because a user does not achieve a particular business result.

If a subscriber believes they are not achieving expected results, kwAI may provide consultation support to review targeting inputs, ideal customer profile configuration, persona alignment, offer positioning, and campaign setup.

After consultation and reasonable adjustment efforts, kwAI may, at its discretion, provide one of the following:

  1. An account credit for the affected billing period if the subscriber wishes to continue using the Service.

  2. A refund for the affected billing period if the subscriber does not wish to continue, subject to the fourteen (14) day refund window and the terms of this Refund Policy.

IV. Service Outages and Platform Issues

kwAI may issue an account credit or refund when a subscriber is materially affected by a platform outage, billing error, technical issue, or service failure caused by kwAI.

Examples may include:

  • Extended platform downtime

  • Billing errors or duplicate charges

  • Loss of access caused by a kwAI system issue

  • Material failure of core platform functionality

  • Technical issues that prevent reasonable use of the Service

Refunds or credits for platform issues are reviewed on a case-by-case basis and may depend on the severity, duration, and impact of the issue.

kwAI may first attempt to resolve the issue, restore access, correct the billing error, or provide account credit before issuing a refund.

This section does not apply to issues caused by user error, third-party systems, internet connectivity, browser settings, unsupported devices, misuse of the Service, or integrations outside kwAI’s reasonable control.

V. Non-Refundable Fees

The following fees are non-refundable:

  • Enterprise onboarding fees

  • Custom onboarding fees

  • Custom implementation or configuration services

  • Professional services

  • Setup fees

These fees cover time, resources, and services rendered and are not eligible for refund once work has commenced, except where required by applicable law.

VI. Early Cancellation

Users may cancel their subscription through their account settings or by contacting support at hey@i-kwai.com.

To avoid renewal charges, cancellation must be completed before the next billing date.

If you cancel your subscription before the end of a billing cycle, your access to the Service will continue through the remainder of the paid billing period in accordance with the Terms of Service.

No prorated refunds are provided for partial billing periods, except where required by applicable law.

VII. Abuse and Terms Violations

Refunds will not be issued in cases involving:

  • Violation of the Terms of Service

  • Abuse of the platform

  • Fraudulent activity

  • Unlawful, abusive, or unauthorized use of prospect data

  • Creation of repeated trial accounts

  • Manipulation of billing systems

  • Attempts to bypass usage limits, trial limits, or plan restrictions

kwAI reserves the right to deny refund requests in such cases.

VIII. Chargebacks

If a chargeback is initiated without first contacting kwAI support to resolve the issue, kwAI may suspend access to the associated account while the chargeback is under review.

Accounts associated with fraudulent, abusive, or repeated chargeback activity may be terminated or restricted from future use of kwAI services.

Nothing in this section limits any rights a user may have under applicable law or through their payment provider.

IX. How to Request a Refund

To request a refund, users must contact support at hey@i-kwai.com within the applicable refund window.

Refund requests must include:

  • The account email

  • The organization name, if applicable

  • The reason for the refund request

kwAI will acknowledge receipt of refund requests within five (5) business days.

If approved, refunds will be processed within ten (10) business days. The time required for funds to appear in your account may vary depending on your payment provider or financial institution.

X. Disputes

Any disputes arising out of or relating to this Refund Policy will be resolved according to the dispute resolution provisions contained in the kwAI Terms of Service.

The parties agree to first attempt to resolve any dispute informally by contacting the other party and engaging in good faith discussions.

XI. Policy Modifications

kwAI reserves the right to modify this Refund Policy at any time.

Changes will be posted within the App or on the Site. Continued use of the Service after changes take effect constitutes acceptance of the updated Refund Policy.

Changes apply prospectively unless otherwise stated or required by applicable law.
